Life is full of changes – a job relocation, a move for personal reasons, or financial difficulties may lead tenants to consider terminating their lease agreement early. In Switzerland, so-called early termination of a lease is possible; however, there are clear rules that tenants should be aware of in order to avoid disputes with the landlord.
Under normal circumstances, a lease agreement may only be terminated as of the ordinary termination date – usually at the end of a contractually agreed notice period (e.g. three months to the end of a month).
Early termination, on the other hand, refers to the premature termination of the lease agreement outside the ordinary termination date. In Switzerland, this generally requires either a legitimate reason or an amicable agreement with the landlord.
The relevant provisions are set out in the Swiss Code of Obligations (CO), Art. 266a–266k. Key aspects include:
Amicable termination:
The tenant may at any time attempt to reach an agreement with the landlord for early termination of the lease. In practice, this is often facilitated by proposing a replacement tenant.
Hardship provision:
Swiss law allows for extraordinary termination in cases of unreasonable hardship (e.g. serious illness or a job relocation to another city).
Proposing a replacement tenant:
In practice, many landlords accept an early termination if the tenant proposes a suitable replacement tenant, thereby shortening the notice period.
Prepare a written notice of termination
Clearly state that the termination is an early termination.
Specify the desired termination date.
If applicable, include the reason (e.g. professional relocation, health-related reasons).
Propose a replacement tenant
Proactively search for a reliable replacement tenant.
Provide the landlord with the contact details so that suitability can be assessed.
Contact the landlord
A personal discussion often facilitates an agreement.
Any agreement should be documented in writing.
Wait for confirmation
The termination becomes effective only once the landlord has given written consent or has accepted a replacement tenant.
Carefully review your lease agreement, as it often contains special provisions regarding early termination.
Comply with the statutory notice periods if no hardship provision applies.
Document all communication in writing in order to avoid disputes at a later stage.
Early termination of a lease agreement is possible in Switzerland, but it requires careful preparation.
